Who Pays for a Fence on the Property Line?
This comes up on almost every shared-line project, and the common assumption – that Texas law requires neighbors to split the cost – isn’t accurate for a standard residential fence.
There’s no general Texas law requiring a 50/50 split
Texas does have a fencing cost-share statute (Agriculture Code Chapter 143) but it applies to rural partition fencing between livestock properties, not standard suburban or HOA-neighborhood lots. For a typical north Houston backyard fence, there’s no statewide law forcing your neighbor to contribute.
What actually happens in practice
In practice, most fences in our area are paid for by whichever owner wants the fence, regardless of whose side benefits most – and that’s a perfectly normal, legal arrangement. Some neighbors do agree informally to split costs, but that’s a private agreement, not a legal requirement.
