Fence Permits by Jurisdiction

Whether you need a permit depends on exactly where your address falls – city limits, unincorporated county, or a township like The Woodlands all have different rules. This is general information, not legal advice; confirm your specific address before you build.

City of Houston

Per the Houston Permitting Center, a standard residential fence 8 feet or under generally doesn’t need a city building permit unless it’s built completely or partially of masonry or concrete, which needs a permit at any height. The Woodlands, Spring, and Magnolia

The Woodlands Township is unincorporated but has its own recorded Residential Development Standards administered through Covenant Administration, so most Woodlands homeowners need DRC approval regardless of city or county permitting – see our HOA fencing page. Spring and Magnolia each apply their own combination of city/county rules; we’ll help identify what applies to your address.

HOA/DRC approval is separate from a government permit

Even where no city or county permit is required, most HOA-governed subdivisions still require design review before you build. Clearing one doesn’t clear the other.
